Mariah Carey's Lollipop Bling/DOLLY Magazine Promotion

1. Information on how to enter and prizes form part of these conditions of entry. Entry into this promotion is deemed to be acceptance of these conditions of entry.

2. The promotion is open to all Australian residents.

3. Employees (and their immediate families) of the Promoter (ACP Magazines Ltd), Elizabeth Arden (Australia) Pty Ltd and agencies associated with this promotion are ineligible to enter.

4. Only one entry per person will be permitted.

5. The promotional period commences September 8, 2010 and closes 11:59pm (AEDST) on October 12, 2010.

6. This is a game of skill. Chance plays no part in determining the winners.

7. Participants may enter the promotion, as follows: DOLLY readers will be directed from the advertorial to www.lollipopbling.com.au, where they enter via the online promotional page. Alternatively, readers can enter via mobile phone through MMS to phone number 0439 181 818. ENTRY: Online - Readers must choose what their favourite Lollipop Bling scent is + upload a photo of themself + tell us in 25 words or less 'Why do you best represent your chosen Lollipop Bling scent?' Mobile - MMS a photo of themself + tell us in 100 characters or less 'What's your Lollipop Bling scent and why do you best represent that scent?', during the promotional period. The MMS mechanism is only open to consumers with an MMS compatible mobile phone connected to a service provider which permits picture messaging to the promotional number. It is recommended that entrants check with their individual service provider before entering via MMS. Entrants under 18 years old must obtain account holder's consent prior to sending an MMS message. This is not a premium rated service. Standard messaging and data rates apply for Australian residents. Any costs associated with entering this promotion will be at the entrant's expense. MMS cost will vary depending on the mobile network used and country of residence. Entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.

8. Each photo must clearly show the face of the entrant or not be obstructed, out of focus, retouched or be defamatory, obscene, derogatory, sexually inappropriate or otherwise objectionable.

9. Entries will be divided into three (3) categories depending on the Lollipop Bling scent specified at time of entry. Entries will then be individually judged, based on the literary, originality, creative merit and the relevance to the Lollipop Bling scent selected, of the answer provided to the promotional question, as well as their suitability to become a Lollipop Bling scent ambassador. The promotion will be judged by a panel of judges appointed by the Promoter. The winners will be notified by phone using contact phone number provided in their entry. The judging of entries will take place at the Promoter's premises and will begin on October 13, 2010 at 10:00am (AEDST).

10. The best entry in each Lollipop Bling scent category, as determined by the judges, will be deemed the winner of the chance to become a Lollipop Bling scent ambassador for that Lollipop Bling scent. Each prize includes a DOLLY photo shoot of the winner at ACP Magazines in Sydney (which includes hair, make up and styling), which will then be published in the Mariah Carey Lollipop Bling advertorial in the DOLLY December issue. Channel V will be there to film the photo shoot which will air as a TV advertisement throughout the entire month of November 2010. In order to attend the photo shoot, each winner will also receive return economy airfares from their nearest Australian capital city to Sydney (if required), 1 night’s accommodation (a shared room with other winners) and return transfers from Sydney airport to the place of accommodation. Total prize value is up to AU$9,000 (photo shoot valued at AU$5,000; flights, accommodation and transfers (if required) valued at up to AU$4,000, depending on date and point of departure).

11. All winners must be available to take the prize on a date specified by the Promoter, which will be either on October 15th, October 18th, October 19th, OR October 20th 2010. The Promoter will notify winners of the exact prize date as soon as practicable, subject to booking and flight availability. If a winner cannot attend the photo shoot on the date specified by the Promoter, the winner will automatically forfeit their right to become a Lollipop Bling scent ambassador and take part in the photo shoot and all associated prizes. In this event, the Promoter may, in its absolute discretion, select the next best valid entrant in that Lollipop Bling scent category as the winner. Any winner under 18 years of age must be accompanied by a parent/guardian over the age of 18. The parent/guardian must pay for their own flights and transfers (if applicable) to accompany the winner.

12. It is a condition of attending the photo shoot that all winners (or their parent/guardian if a winner is under the age of 18) provide original photo identification, to the satisfaction of the Promoter, as proof of identity and residency. It is also a condition of attending the photo shoot that all winners (or their parent/guardian if a winner is under the age of 18) sign a legal release, in the form determined by the Promoter in its absolute discretion, warranting that the winner has no criminal record, consenting to the Promoter's use of the winner's name, voice and image in any media worldwide for any marketing, advertising and/or publicity purposes for an unlimited period, without any further reference or payment to the winner, and further warranting that there is no restriction or obligation which would prevent such use by the Promoter. Winners must, at the Promoter's reasonable request, participate in all promotional activity (such as publicity events and/or other photo shoots) surrounding the winning of their prize, without remuneration. The Promoter will determine, in its absolute discretion, the nature and level of involvement and media exposure for all marketing/advertising/promotional/publicity activities. The Promoter is not obliged to use a winner's image in any media (including, but not limited to, television commercials, video/audio materials, and stills photographic materials) produced as a result of the winner's participation in this promotion. The Promoter also reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determine, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate.

13. Unless otherwise stated, prizes do not include any ancillary costs associated with redeeming the prize. These costs are the responsibility of the winner. Where a prize, or an element of a prize, is unavailable for any reason, the Promoter may substitute for that prize another item or equal or higher value as determined by the Promoter.

14. Entries not completed in accordance with these conditions of entry or received after the closing date will not be considered. Indecipherable or incomplete entries will be deemed invalid. The judges' decision in relation to any aspect of the promotion is final and binding on every person who enters. No further correspondence will be entered into.

15. Prize valued in Australian dollars. Prize values are the recommended retail value as provided by the supplier and are correct as at July 16th 2010. The Promoter and Elizabeth Arden (Australia) Pty Ltd accept no responsibility for any variation in the value of any element of a prize. Prizes, or any unused portion of an element of a prize, are not transferable or exchangeable and cannot be taken as cash.

16. Except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law, the Promoter, Elizabeth Arden (Australia) Pty Ltd and their officers, employees, agents and associated companies exclude all liability (whether or not arising from any person's negligence) for any expense, damage, personal injury or death; or any loss or damage (including loss of opportunity) whether, without limitation, direct, indirect, special or consequential loss or loss of profits, arising in any way out of the promotion (or accepting or using any prize), including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) redemption of a prize; and/or (g) participation in the promotion, taking of a prize or attendance at the photo shoot.

17. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.

18. If for any reason this promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries.

19. By entering the promotion, the entrant consents to receipt of any email regarding the promotion, from the Promoter and other emails which inform the entrant of the Promoter's other publications, products, services and events and to promote third party goods and services it may be interested in. All entries submitted become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this promotion is governed by the Privacy Notice (see the contents page of the latest issue of Dolly magazine for its location). Entries will not be returned to any entrant.

20. By entering this promotion, each entrant warrants to the Promoter that each entry is an original work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoter is entitled to use any of the entries submitted for any purposes at its discretion, including (but not limited to) for any future promotion, marketing and publicity purposes. By entering, entrants consent to the Promoter or Elizabeth Arden (Australia) Pty Ltd making copies of or publishing the whole or any part of their answer to the promotional question (provided at time of entry) for any purpose for an unlimited period, without remuneration.
